MINUTES OF THE REGULAR MEETING OF THE STAUNTON CITY COUNCIL, HELD IN THE PUBLIC WORKS BUILDING, 914 NORTH EASTON ST., STAUNTON, ILLINOIS ON MONDAY, APRIL 22, 2019

 

I.          CALL TO ORDER:

 

            Mayor Craig Neuhaus called the Staunton City Council Meeting to order at 7:00 P.M. on Monday, April 22, 2019

 

II.        PLEDGE OF ALLEGIANCE:

 

            Mayor Craig Neuhaus led the Pledge Allegiance to the Flag.

 

 III.      ROLL CALL:

            letter was dated April 3, 2019, and his resignation was effective that day.

Motion by Pritchett, seconded by Johnson to pay Invoice #DED4922655 to Illinois Counties Risk Management Trust for the City’s deductible on liability claim in the amount of $5,000.00.  Ayes:  Johnson, Schrauth, Plenske, Pritchett, Scanzoni, Bodner.  Nayes:  None.  Absent:  Garde, Scroggins.  Motion carried.

 

Motion by Pritchett, seconded by Plenske to approve quote from Erb Equipment Co. for a 60 month Extended Warranty for the 310 SL John Deere Backhoe at a cost of $4,320.00.  Ayes:  Schrauth, Plenske, Pritchett, Scanzoni, Bodner, Johnson.  Nayes:  None.  Absent:  Garde, Scroggins.  Motion carried.

 

UTILITIES-

 

Motion by Pritchett, seconded by Johnson to pay Invoice #4789 to Coating Inspection Services, LLC for ground storage tank inspections at the water treatment plant in the amount of $5,000.00.  Ayes:  Schrauth, Plenske, Pritchett, Scanzoni, Bodner, Johnson.  Nayes:  None.  Absent:  Garde, Scroggins.  Motion carried.

 

Motion by Pritchett, seconded by Bodner to pay Invoice dated April 17, 2019 from John H. Crawford & Associates for Design Engineering on the El Indio Sewer Extension Project at a cost of $17,100.00.  This will be paid from the Interstate TIF Fund.  Ayes:  Plenske, Pritchett, Scanzoni, Bodner, Johnson, Schrauth.  Nayes:  None.  Absent:  Garde, Scroggins.  Motion carried.

 

Motion by Pritchett, seconded by Plenske to pay Invoice dated April 17, 2019 from John H. Crawford & Associates for design completed for the Renken Road/VFW Road Water Line Replacement IEPA Permit in the amount of $5,482.50.  Ayes:   Pritchett, Scanzoni, Bodner, Johnson, Schrauth, Plenske.  Nayes:  None.  Absent:  Garde, Scroggins.  Motion carried.

            JUDICIARY—

 

Motion by Bodner, seconded by Plenske to approve Ordinance #1979 Annexing Certain Territory To The City Of Staunton, Macoupin County, Illinois (526 Bentrup Road).  Ayes:  Scanzoni, Bodner, Johnson, Schrauth, Plenske, Pritchett.  Nayes:  None.  Absent:  Garde, Scroggins.  Motion carried.

 

Motion by Bodner, seconded by Pritchett to approve Ordinance #1982 Making Appropriations For The Fiscal Year Beginning May 1, 2019 And Ending April 30, 2020.  Ayes:  Bodner, Johnson, Schrauth, Plenske, Pritchett, Scanzoni.  Nayes:  None.  Absent:  Garde, Scroggins.  Motion carried. 

 

Alderman Johnson would like to make a motion to Commit Ordinance 1984 back to the Judiciary Committee.  Ordinance 1984, contains 19 separate easements for two separate projects, 10 easements for the Storm Sewer System and for the 9 Water System.  This Ordinance does not allow each easement nor the separate projects get their due and individual consideration.  It is either vote for them all or vote against them all. 

Several of the easements for the Storm Sewer project also have some troubling wording:  (Specifically including the injection of flowable grout into existing storm sewer located under the existing building at the location owned by the Grantor.  Flowable grout will be utilized to seal existing storm sewer to eliminate present void caused by said storm sewer.  Grouting of said existing storm sewer is not intended to provide any structural support to existing building.)

This wording gives me pause for several reasons.  Does the grouting include the washout and not just the existing storm sewer?  After having seen not only firsthand but in the videos and photos taken exposed floorboards of the buildings as well as utility connections such as water and sewer.  Will these be incased with the flowable grout as well?  And if so where is the language holding the City harmless for failure of these connections and resulting repairs if necessary in the future? 

I believe it is necessary to have the engineers come in and explain the details of this process and/or answer questions.  Especially as it relates to City liabilities and responsibilities for the future in regards to this procedure on private property.

 

Motion by Johnson, seconded by Plenske to table the 1st reading of Ordinance #1984 Approving Acquisition Of Certain Water And Storm Sewer System Right-Of-Way Easements In Staunton, Illinois.  Ayes:  Bodner, Johnson, Plenske.  Nayes:  Schrauth, Pritchett, Scanzoni.  Absent:  Garde, Scroggins.   Due to a tie vote, Mayor Neuhaus cast the tie breaking No vote.  The motion to table the 1st reading of Ordinance #1984 failed with 3 Ayes and 4 Nayes.

 

Motion by Bodner, seconded by Pritchett to waive 1st reading of Ordinance #1984 Approving Acquisition Of Certain Water And Storm Sewer System Right-Of-Way Easements In Staunton, Illinois.  Ayes:  Schrauth, Pritchett, Scanzoni.  Nayes:  Johnson, Plenske, Bodner.  Absent:  Garde, Scroggins.  Due to a tie vote, Mayor Neuhaus cast the tie breaking Yes vote.  The motion to waive the 1st  reading of Ordinance #1984 passed with 4 Ayes and 3 Nayes. 

 

Motion by Johnson, seconded by Plenske to table the approval of Ordinance #1984 Approving Acquisition Of Certain Water And Storm Sewer System Right-Of-Way Easements in Staunton, Illinois.  Ayes:  Bodner, Johnson, Plenske.  Nayes:  Schrauth, Pritchett, Scanzoni.  Absent:  Garde, Scroggins.  Due to a tie vote, Mayor Neuhaus cast the tie breaking No vote.  The motion to table the approval of Ordinance #1984 failed with 3 Ayes and 4 Nayes.

Motion by Bodner, seconded by Plenske to waive 1st reading of Ordinance #1985 Amending Ordinance 1913 And Renumbering Certain Sections Of The Staunton Revised Code.  Ayes:  Schrauth, Plenske, Pritchett, Scanzoni, Bodner.  Nayes:  Johnson.  Absent:  Garde, Scroggins.  Motion carried 5 Ayes; 1 Naye.

 

Motion by Bodner, seconded by Plenske to approve Ordinance #1985 Amending Ordinance 1913 And Renumbering Certain Sections Of The Staunton Revised Code.

Ayes:  Plenske, Pritchett, Scanzoni, Bodner, Schrauth.  Nayes:  Johnson.  Absent:  Garde, Scroggins.  Motion carried 5 Ayes; 1 Naye.

 

Alderman Johnson would like to make a motion to Commit Resolution #2019-01 back to the Judiciary Committee.  The Hot Air Tether Agreement does not include the same insurance language of the Administration and Direction of Balloon Event agreement:  WindDancer will provide valid and current certificates of insurance for each participating balloon.  The participants are required by WindDancer to carry a minimum of $1,000,000. In liability coverage, and shall cause the City of Staunton to be named as an additional insured on all policies.  Shouldn’t The City be named as an additional insured on both contracts?

 

            Motion by Johnson, seconded by Pritchett to table Resolutiion #2019-01 Approving

            A Balloon Glow Agreement And Hot Air Balloon Tether Agreement With

            WindDancer Balloon Promotions, LLC.   Ayes:  Bodner, Johnson, Plenske, Pritchett.

            Nayes:  Schrauth, Scanzoni.  Absent:  Garde, Scroggins.  Motion to table Resolution

            #2019-01 passed with 4 Ayes and 2 Nayes.

 

I would like to make a motion to Commit Resolution #2019-02 back to the Judiciary Committee Approving Release of Closed Session Minutes And Authorizing Continuing Retention Of Non-Related Minutes.  The resolution states:  Whereas, the City Board has reviewed all non-released closed session minutes and has determined the closed session minutes associated with the meetings listed on Exhibit A, which is attached hereto and adopted and incorporated by reference as if set forth fully herein, are approved for release.  The list contains meetings held prior to my election as Ward 2 Alderman on April 4th, 2017.  The minutes listed date back to January 12, 2015 to December 10, 2018 including 34 meetings 8 of which I was not on the Board and privy to.  I would like the opportunity to review these minutes, as I am sure other Council Members who were not on the board or may have forgotten the nature and content of the meetings would as well before voting.

            Release Of Closed Session Minutes And Authorizing Continuing Retention Of Non-

            Released Minutes.  Ayes:  Johnson, Plenske.  Nayes:  Bodner, Schrauth, Pritchett,

 Mayor Neuhaus will be calling a meeting soon regarding the vacancies on the Police

 Pension Board.  If anyone has any suggestions for possible board members, please let

 Mayor Neuhaus know as soon as possible.  As of this time, there are two positions

 open on the board.
